Directors and Officers Liability

Ohrenstein & Brown, LLP has considerable expertise in liability and insurance issues pertaining to directors and officers. Our attorneys regularly represent and consult with a wide variety of insurers, directors, officers and corporations concerning directors and officers issues.

We offer our clients extensive coverage analysis of issues unique to the directors and officers practice area (including analysis of damage calculations), preparation of reservation of rights and disclaimer letters, active monitoring of underlying actions and proceedings from inception through trial or settlement. In addition, where we are not serving as defense counsel, we work closely with defense counsel in working through settlements, including, when necessary, negotiating directly with plaintiffs' counsel.

Somewhat unique to our directors and officers liability group is its extensive trial experience, including representation of directors and officers insurers in declaratory judgment actions adjudicating the rights and potential coverage obligations of the insurers vis-a-vis their insureds. As a result of this litigation experience, we not only bring a somewhat different focus to our coverage investigations, but we have thorough familiarity with the laws of many states, including New York, California, Florida, Texas, Massachusetts and Pennsylvania, since our representation of insurers covers federal and state courts throughout the country.
