Over the last few months, there have been efforts to seek modifications to the Thompson Memorandum. Senator Arlen Specter introduced the "Attorney-Client Privilege Protection Act" and Deputy Attorney General Paul McNulty's proposed changes to FRE 502(c). This presentation reviews those efforts and provides a top ten list for avoiding an inadvertent waiver of the attorney-client privilege.
