O&B Successful in Claim for Contractual Indemnification

In Pavelchak v. Antar-Com, et al., after obtaining a voluntary discontinuance of all claims brought by plaintiff, O&B moved the court on behalf of its client Diebold Incorporated for summary judgment on its claim for contractual indemnification against a co-defendant. That co-defendant argued that the contract did not provide Diebold an entitlement of defense and indemnification. Upon procuring an affidavit from a corporate executive of the client and detailing the relevant language of the contract, Diebold was awarded summary judgment and recouped a significant portion of its defense costs.
